Hundreds of Uber Driver Assault Lawsuits Filed Nationwide
Uber is facing about 200 sex assault lawsuits nationwide from women who were sexually assaulted or harassed by a driver.
Can I Join a Class Action Lawsuit?
The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a class action lawsuit against Uber. Instead, we are filing individual lawsuits for women who were sexually assaulted, harassed, groped, abducted or raped by an Uber driver.
About Class Actions
Class actions are filed by one person, called a “class representative,” on behalf of a much larger group of people with similar legal claims. This can be a problem for people with severe injuries because if there is a payout, the money will be split with everyone in the class action.
Why Our Law Firm is Filing Individual Lawsuits
Uber is already facing hundreds of lawsuits from women who were sexually assaulted by an Uber driver. The plaintiffs in these lawsuits are seeking to hold Uber accountable for failing to protect women.
Lawsuits claim that Uber has failed to adequately screen drivers, perform background checks, or take other steps to protect women from being assaulted, such as allowing women to choose the gender of their driver, or requiring surveillance cameras inside of cars.
Bogus “Safe Ride Fees” Raked in $500 Million
Uber implemented “Safe Ride Fees” of $1 per ride in 2014 to perform background checks for drivers. However, lawsuits claim that the money did not actually make passengers safer, and in fact was a bogus surcharge that raked in $500 million for Uber, according to New York Times reporter Mike Isaac. It was not until several years after implementing the “Safe Ride Fee” that Uber started adding actual safety features to the app, such as an emergency 911 button.
Uber Pays $28.5 Million Settlement for “Safe Ride Fees”
The bogus “Safe Ride Fees” resulted in multiple class action lawsuits, which ended in a $28.5 million settlement from riders who claimed that they were misled. Uber also agreed to re-name the “Safe Ride Fee” as a “Booking Fee,” which is still found on the bill for Uber rides.
What Has Uber Done to Improve Safety?
Uber has taken steps to improve safety, such as:
- RideCheck to verify that the ride is not going off-course or ending early
- PIN verification of drivers
- Audio recording of the ride
- Share My Trip: Option to share live location and trip details with friends / family
- Other features, such as Text-to-911, SeatBelt Alerts, sharing driver safety information with Lyft, etc.)
How Many Women Have Been Sexually Assaulted by Uber Drivers?
In July 2022, Uber delivered a second Safety Report, in which the company reported 3,824 incidents across the five most severe categories of sexual assault and misconduct in 2019 and 2020.
Uber Driver Assault Lawsuits Centralized in MDL
In October 2023, federal judges centralized the litigation under U.S. District Judge Charles R. Breyer in the Northern District of California.
All of the lawsuits accuse Uber of failing to implement appropriate safety precautions to protect passengers. Plaintiffs are former Uber passengers who were sexually assaulted or harassed by their drivers.
The MDL is: In re: Uber Technologies, Passenger Sexual Assault Litigation (MDL No. 3084).
