What is the problem?

Uber offers the “safest rides on the road,” but driving is an inherently dangerous job and not everyone is good at it. You may have seen drivers speeding, weaving in and out of traffic, failing to signal or yield, or getting distracted by their phone, app, navigation, or passengers.

Uber Car Accident Lawsuit

Uber is a $40 billion dollar company with tens of thousands of drivers providing millions of trips around major cities in the United States. As the popularity of the ride-sharing app has grown, so has the number of car accidents involving Uber drivers — and the number of lawsuits.

$1 Million Uber Insurance Coverage

Uber drivers carry $1 million in insurance coverage to compensate people who were injured in car accidents, including car accidents with uninsured or under-insured vehicles. In comparison, many ordinary drivers carry as little as $15,000 insurance policies. What that means is that people who were injured in Uber car accidents may be eligible for significant compensation to cover medical expenses and disability.

Examples of Car Accident Lawsuits

Here are a few examples of car accidents that may qualify for compensation under Uber’s insurance policy:

  • Uber passengers injured in a car accident (only while in the vehicle)
  • Uber drivers injured in a car accident where the other motorist was at fault
  • Motorists injured in a car accident where the Uber driver was at fault

Uber Lawsuit Settlement Over Wrongful Death

In August 2016, Uber paid a confidential settlement to the family of a 6 year-old girl who died in an accident with an Uber. The girl, Sofia Liu, was hit by an on-duty Uber driver while walking with her mother and brother in a cross-walk on New Year’s Eve in San Francisco in 2013.

Paralyzed Woman Files Uber Accident Lawsuit

In January 2017, a 24 year-old college student who was paralyzed from the chest down in a car accident filed a lawsuit against Uber for failing to adequately screen its drivers. She says:

“It could have been anyone. Millions of people trust Uber with their lives, and they obviously aren’t doing it the right way.”

The lawsuit was filed by Sarah Milburn, a woman who got into the back of a Uber after a night out in Dallas with friends. On the way home, her driver sped through a red light and was T-boned at an intersection by a Ford F-150 pickup truck.

The rollover crushed her spine and left her permanently paralyzed. The lawsuit was filed after lawyers discovered that the driver had a criminal history and was driving an uninsured vehicle that belonged to someone else. The driver was not charged in the accident.

How Does Uber Pre-Screen Drivers?

Uber drivers can start the pre-screening process in minutes online. Uber uses a private 3rd-party to run background checks. Drivers must have a social security number, license, vehicle, and a clean (non-violent) criminal background. Uber does not accept drivers who have had a recent DUI, reckless driving, or serious speeding violation.

Uber Accident Injuries

  • Traumatic brain injuries
  • Spinal cord damage
  • Paralysis
  • Whiplash and neck injuries
  • Amputation or loss of limb
  • Burns
  • Broken bones
  • Death
