April 5, 2022 — A wrongful death lawsuit has been filed by angry parents who blame Snapchat for a car accident that killed three teenage boys, according to Law360.
The lawsuit alleges that the Snapchat “Speed Filter” encouraged reckless driving that led to a devastating car accident in Wisconsin.
Snap Inc. introduced the “Speed Filter” in 2013, an app that allows users to post their current speed on photos and get rewards.
In May 2017, the boys were driving at high speeds while using Snapchat, reaching 123 miles per hour, and crashed into a tree going around 113 mph. All three boys died in the accident.
According to the lawsuit, the boys were using Snapchat’s “Speed Filter,” believing they could receive rewards and trophies in the app by posting a video of themselves going more than 100 mph.
The lawsuit alleged that the “Speed Filter” was designed to encourage reckless speeding.
Snapchat removed the “Speed Filter” in June 2021 after it was linked to numerous high-speed crashes and deaths, which sparked several wrongful death lawsuits.
Snap claimed immunity under Section 230 of the Communications Decency Act, but the Ninth Circuit judges disagreed, finding that the “Speed Filter” was a featured of the app and not user content.
The case is Lemmon et al. v. Snap Inc., filed in the U.S. District Court for the Central District of California — Case Number 2:19-cv-04504.
