What Happened?
In September and October 2024, fresh slivered onions on McDonald’s Quarter Pounder Hamburgers were linked to a deadly E. coli outbreak that sickened at least 104 people in 14 states nationwide, including one person who died in Colorado.
McDonald’s Class Action Lawsuits for E. Coli Outbreak
A class action lawsuit has been filed against McDonald’s for everyone who bought McDonald’s Quarter Pounders that may have been contaminated with E. coli — even people who did not get sick.
The lawsuit was filed by two consumers in Illinois and Florida who fell ill and “began experiencing many of the symptoms associated with E. coli infection” after eating Quarter Pounders in October 2024.
Their class action is seeking to represent a “nationwide class” of all people in the U.S. who bought McDonald’s Quarter Pounders that were contaminated with E. coli, even if they did not get sick.
They are seeking at least $5 million to reimburse everyone who bought Quarter Pounders and qualifies to join the class action lawsuit.
What Does The Class Action Lawsuit Claim?
The lawsuit accuses McDonald’s of failing to warn consumers that Quarter Pounders could present a risk of E. coli contamination.
The plaintiffs claim that McDonald’s knew (or should have known) that fresh onions on Quarter Pounders could pose a risk of food poisoning, but McDonald’s failed to warn people about the risk of E. coli.
Had the plaintiffs known about the risk of E. coli, they never would have eaten Quarter Pounders, or they would have paid less.
The lawsuit is seeking refunds and reimbursements for people who bought Quarter Pounders, because they “spent money on a product that did not have any value, or had less value than warranted.”
The class action lawsuit was filed against McDonald’s USA, LLC on October 29, 2024 in the U.S. District Court for the Northern District of Illinois — Case Number 1:24-cv-11102.
About Class Actions
The class action lawsuit against McDonald’s can involve people who did not get sick, such as people who are seeking money for refunds after buying Quarter Pounders. If money is awarded, the payout would be divided with everyone who qualifies to join the class action lawsuit.
Individual Lawsuits vs. Class Action Against McDonald’s
Lawsuits have also been filed against McDonald’s by people who got sick with E. coli after eating Quarter Pounders in many states.
The first lawsuits were filed by people in Colorado, which has been the hardest-hit state in this outbreak. At least 30 people in Colorado got sick with E. coli, including an older man who died.
Many people who got sick will probably file lawsuits against McDonald’s, but not as part of a class action. Instead, these are individual lawsuits for food poisoning, rather than a class action. Unlike a class action, the payout would not need to be shared with other people who got sick.

There are many advantages of filing individual lawsuits for food poisoning. Infections with E. coli can be very serious, with severe symptoms, long-term complications, hospitalization, or even death.

How Much Money Is My Lawsuit Worth?
There is no way to know how much money each lawsuit could be worth, because it depends on the individual circumstances of each case. In general, food poisoning lawsuits will seek compensation for pain and suffering, medical bills (past and future), long-term health problems, lost income, decreased quality of life, wrongful death, and other damages.
Can I Join A Class Action Lawsuit?
Yes. Lawsuits are being filed by people who got sick after eating at McDonald’s in September and October 2024. The strongest cases will involve people who were diagnosed with E. coli.
Some of these lawsuits involve very severe injuries. For example, one of the victims is a 15-year-old girl from Colorado who was hospitalized with kidney failure due to a severe E. coli complication called Hemolytic Uremic Syndrome (HUS).
