FDA Evaluating Rhabdomyolysis Risk

The FDA is evaluating a potential signals of a serious risk and new safety information linking DPP4 diabetes drugs and rhabdomyolysis. This potentially life-threatening kidney side effect was identified by the FDA Adverse Event Reporting System (FAERS) between April and June 2017.

Kazano and Pancreatic Cancer

Kazano (alogliptin) is a diabetes drug that works by mimicking digestive hormones called incretins, which tell the pancreas to release more insulin in response to food. It belongs to a class of drugs called “incretin mimetics.”

Drugs in this class are under investigation for over-stimulating the pancreas and causing a variety of severe side effects, including:

  • Pancreatitis (pancreas inflammation)
  • Hemorrhagic pancreatitis
  • Necrotizing pancreatitis
  • Pre-cancerous growths (pancreatic duct metaplasia)
  • Pancreatic cancer

FDA Safety Warnings

The first incretin mimetics on the market were linked to pancreatitis in 2008. In 2010, a study published in Gastroenterology found higher rates of pancreatic cancer. In March 2013, the FDA issued a Safety Alert about a study published in Diabetes. Researchers found pre-cancerous growths in pancreases of people who took drugs in the incretin mimetic class.

Hundreds of Lawsuits Consolidated in MDL

Over 750 individual lawsuits involving side effects of incretin mimetic diabetes drugs have been centralized into one federal court in California, Multi-District Litigation (MDL No. 2452).

Consolidating lawsuits into a MDL or “mass-tort” has many of the advantages of a class action, such as improved efficiency and avoiding conflicting rulings in different courts. However, unlike a class action, individual cases in a MDL remain independent.

What is the problem?

The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we are not filing a Kazano class action. Instead, we are filing individual lawsuits and only accepting cases involving severe side effect like pancreatic cancer.

About Class Actions

When a lot of people have similar legal claims, class actions are an efficient way to resolve the litigation all at once. The lawsuit is filed by a “class representative,” and lawyers use that person’s case to argue for compensation on behalf of everyone.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

Any compensation awarded in a class action is divided equally among everyone who joins the lawsuit. In some cases, attorneys accept a “low-ball” settlement and take huge cuts of the payout, leaving little remaining.

Instead of a class action, our lawyers are filing individual lawsuits. We specialize in filing lawsuits against pharmaceutical companies who sell unsafe medications. We only accept cases involving very serious injuries and we focus on helping our clients recover compensation for their medical expenses, long-term injuries, and more.
