September 22, 2016 — Invokana lawyers have asked a panel of federal judges to centralize dozens of lawsuits in a Multi-District Litigation (MDL) in New Jersey.
On September 20, the U.S. Judicial Panel on Multidistrict Litigation (JPML) received a motion (PDF) to coordinate the cases under U.S. District Judge Brian R. Martinotti in New Jersey.
Judge Martinotti was appointed to the federal bench in July after serving as the state-level mass-tort judge since 2009. He currently presides over 36 Invokana lawsuits in New Jersey.
Nationwide, a total of 56 lawsuits are pending in 11 district courts. All of the lawsuits accuse Janssen Pharmaceuticals of downplaying the risk of severe side effects, including ketoacidosis and kidney damage.
Janssen is headquartered in New Jersey, where most — if not all — of the potentially relevant documents and depositions will be located.
The MDL process eliminates duplicative discovery, avoids inconsistent pretrial rulings, and improves convenience for everyone involved. Lawyers prepare a few cases for trials and use the outcomes to negotiate a settlement or resolve other cases with similar allegations.
The FDA has issued numerous safety warnings about Invokana since its approval in March 2013. Earlier this year, the agency strengthened warnings about acute kidney injury. Last year, multiple warnings were issued about diabetic ketoacidosis.
The two most common side effects of Invokana — dehydration and infections — are risk-factors for ketoacidosis and kidney problems. Invokana has also been associated with toe amputations, bone fractures, and life-threatening urinary tract infections (UTIs) that invade the kidneys or bloodstream.
