UPDATE: Gastroparesis Lawsuits Being Filed Nationwide

Dozens of gastroparesis lawsuits have been filed against pharmaceutical companies, such as Novo Nordisk and Eli Lilly Co.

What is Gastroparesis?

Gastroparesis is also called stomach paralysis because it occurs when the movement of food slows down through the digestive system. In severe cases of gastroparesis, the digestion of food slows down significantly or stops completely, resulting in an intestinal obstruction.

Signs & Symptoms of Gastroparesis

  • Nausea
  • Vomiting (may contain undigested food)
  • Bloating
  • Loss of appetite
  • Feeling full soon after starting to eat
  • Abdominal pain
  • Weight loss
  • Heartburn

Severe Complications of Gastroparesis

Gastroparesis can cause severe health problems, especially over time. Patient may suffer from malnutrition, dehydration due to excessive vomiting, problems controlling blood-sugar levels, and hardened masses of undigested food that cause blockages. There is also a risk of being hospitalized due to gastrointestinal blockages.

Gastroparesis Lawsuits Centralized in MDL

The gastroparesis Multi-District Litigation (MDL 3094) is located in the U.S. District Court for the Eastern District of Pennsylvania, where the litigation is overseen under U.S. District Judge Mitchell S. Goldberg — In Re: Glucagon-like Peptide-1 Receptor Agonists (GLP-1 RAS) Products Liability Litigation.

Can I Join a Class Action?

Instead of a class action lawsuit, gastroparesis lawsuits against Novo Nordisk and Eli Lilly & Co. have been centralized into a MDL.

What is the Gastroparesis MDL?

The MDL involves personal injury lawsuits involving the use of GLP-1 medications for type-2 diabetes. The medications are Ozempic, Wegovy, and Rybelsus, which are manufactured by Novo Nordisk, and Trulicity and Mounjaro, which are manufactured by Eli Lilly & Co.

The lawsuits involve different medications, but they were centralized into the MDL because they share common questions of fact:

“Each lawsuit contains substantially similar allegations about GLP-1 RAs (specifically, Ozempic, Wegovy, Rybelsus, Trulicity, and/or Mounjaro) and their alleged propensity to cause gastrointestinal injuries.”

What Do Lawsuits Allege?

The lawsuits share common issues of fact regarding whether drug-makers knew (or should have known) that their GLP-1 medications can cause gastroparesis and other gastrointestinal injuries.

The lawsuits also question whether the defendants adequately warned plaintiffs or their prescribing physicians about the alleged dangers of these products; and whether defendants made false, misleading, or incomplete representations regarding the safety of these products.
