Lawsuits have been filed by people who had health problems after consuming energy drinks like Rockstar, Red Bull, and Monster Energy. In very high doses, caffeine is dangerous for the heart and B-vitamins like niacin can cause liver damage.

Overview
Energy drinks pose serious risks for many reasons. They often contain hundreds of milligrams of caffeine, which can cause caffeine toxicity from consuming just a couple cans. Other ingredients can also be dangerous. For example, there are reports of people who developed sudden liver inflammation (hepatitis) from consuming high doses of niacin (Vitamin B3) in energy drinks for several weeks.
What is the problem?
Another problem is that energy drinks are often sold as “dietary supplements” rather than beverages. These products are subject to less-rigorous requirements from the FDA — for example, labels do not need to include the amount of caffeine or ingredients.
Higher Risks for Teens and Young Adults
Many energy drinks are also marketed to young adults and teenagers. Young people are more likely to drink several energy drinks in one day. They may also be tempted to mix energy drinks with alcohol, which increases the risk of complications.
Individual Lawsuits Not Part of Class Action
In February 2016, a law firm in Orlando filed a group of five lawsuits against Monster Energy. The victims included a 14 year-old boy who had a stroke and several people who had kidney problems. The law firm said it is investigating another 100 claims.
Wrongful Death Lawsuits
This is not the first time lawsuits have been filed. In 2012, families of a 14 year-old girl and a 19 year-old boy who died after drinking Monster Energy filed lawsuits. These lawsuits are not part of a class action. Instead, they are individual lawsuits.

What is the problem?
The Schmidt Firm, PLLC is nationally recognized as a class action law firm. However, our lawyers aren’t filing an energy drink class action. Instead, we are filing individual lawsuits involving serious side effects, such as heart attack, toxic hepatitis (liver inflammation), and acute non-viral hepatitis.
About Class Actions
Class actions have already been filed, but not for people who were injured. Instead, they are seeing refunds for everyone who bought energy drinks. In a class action, everyone joins together and collectively seeks reimbursement for purchasing that product. Any payout is divided equally among plaintiffs.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
Class actions are not designed to maximize compensation for individual plaintiffs with the most serious injuries. This is why it is unlikely that a class action will be filed for people who were injured by energy drinks. Members of a class action might have to accept a “low-ball” settlement or massive attorneys’ fees.
Instead of a class action, our lawyers file individual lawsuits. We believe there is no excuse for companies that sell highly-caffeinated energy drinks without listing the amount of caffeine on the label or warning about the risks. If you were injured, you could receive compensation for pain and suffering, past and future medical expenses, lost income, permanent injuries, and more.
