$18 Million Awarded in Barbershop Mesothelioma Lawsuit
In October 2016, a jury awarded $18 million to a man from Los Angeles who developed mesothelioma from exposure to asbestos in Clubman Talc and other products at the barbershop where his father worked.
Philip Depoian was diagnosed with mesothelioma in 2015, decades after he was exposed to asbestos in talcum powder products like Clubman, Old Spice, Kings Men, and Mennen Shave Talc. He agreed to a confidential settlement before the jury could award punitive damages.
The lawsuit was filed against talc supplier Whittaker, Clark and Daniels. The company was accused of of advertising talc as asbestos-free without testing it to make sure it did not have asbestos.
The lawsuit was Los Angeles Superior Court — In Re: Philip Depoian et. al., vs. American International Industries, et al. — Case No. No. BC607192.
Talc and Asbestos
Asbestos and talc are often naturally found together underground. The FDA banned asbestos in cosmetics in 1976. Before then, talcum powder was often extremely contaminated with asbestos. Some of the most popular talc products at the time contained up to 20% asbestos.
Does Clubman Have Asbestos?
Clubman Talc is asbestos-free today, but it might have been contaminated with asbestos in the past. Only pure talc is allowed in cosmetics, but the industry is mostly left to monitor itself. The FDA tested 34 products in 2009 and 2010 and found that none of them had asbestos.
Clubman Talc and Cancer
It is unlikely that many women used Clubman Talc on their genital area, but a lot of women use other talcum powder products this way. Studies estimate a 20-30% increased risk of ovarian cancer. Talc particles were found in the ovaries of women with cancer in the 1970s, proving it can migrate through the reproductive system.
What is Mesothelioma?
Mesothelioma is a rare but aggressive type of lung cancer that occurs several decades after exposure to asbestos. It is actually very similar to the most common type of ovarian cancer. Both types of cancer start in cells on the outer surface of the lungs or the ovaries.
Symptoms of Mesothelioma
- Chest pain
- Shortness of breath
- Fever
- Abdominal pain
- Fluid buildup
- Nausea
- Loss of appetite
- Weight loss
