$12.4 Million Awarded in “Cashmere Bouquet” Mesothelioma Lawsuit
In April 2015, a jury in Los Angeles awarded nearly $13 million to a 73 year-old woman who was diagnosed with mesothelioma after using Cashmere Bouquet. The plaintiff, Judith Winkel, used it nearly every day for over a decade, between 1961 and 1976. Every time, it created “a little cloud, like a dust cloud.” Her attorneys say that dust cloud contained microscopic particles of asbestos, which she breathed in the air. Lawsuits claim that for decades, Colgate-Palmolive used talcum that came from mines they knew were contaminated with asbestos.
What is the problem?
Cashmere Bouquet is an iconic feminine talcum powder product that was sold from the late-1800s until 1995, when it was discontinued by Colgate-Palmolive. Before the 1970s, when the FDA banned asbestos in consumer products, it was not uncommon for talcum to be contaminated.
Asbestos and Mesothelioma
Mesothelioma is a rare but highly-aggressive type of lung cancer that is primarily associated with asbestos, a known carcinogen. If you look at asbestos under a microscope, it typically looks like a bundle of fibers or needle-like splinters. When these tiny fibers are inhaled, they are extremely irritating to tissues in the lungs. In some cases, fibers penetrate through the lining of the lungs and into the chest wall — eventually leading to lung cancer.
Asbestos in Talcum Powder Linked to Mesothelioma
In October 2014, the International Journal of Occupational and Environmental Health published a study that traced asbestos-contaminated talcum from a mine, into a consumer product, and in the lung tissues from a woman who died from mesothelioma. The researchers warned:
“The inhalation of talc may cause lung fibrosis in the form of granulomatose nodules called talcosis. Exposure to talc has also been suggested as a causative factor in the development of ovarian carcinomas, gynecological tumors, and mesothelioma.”
