Hundreds of Lawsuits Centralized in MDL
Hundreds of lawsuits have been filed by people who were injured by Byetta, but not as part of a class action. Instead, the lawsuits have been centralized in one federal court in Southern California since August 2013.
As of February 2016, there were 767 lawsuits pending in Multi-District Litigation (MDL No. 2452) under Judge Anthony Battaglia. All of the plaintiffs accuse drug-makers of failing to warn that incretin therapy drugs (Byetta, Januvia, Victoza, etc.) can cause pancreatic cancer.
Byetta Class Action Lawsuit
The Schmidt Firm, PLLC is nationally recognized as a class action law firm, but we have decided against filing a Byetta class action lawsuit. However, we are currently filing individual lawsuits. We encourage you to contact us if you or a loved one experienced any of the following side effects:
- Pancreatitis
- Acute pancreatitis
- Necrotizing pancreatitis
- Hemorrhagic pancreatitis
- Kidney damage
- Kidney failure
- Pancreatic cancer
- Thyroid cancer
- Death
About Class Actions
Class actions are filed in state court on behalf of a large “class” of people who have very similar injuries and claims. All of the individual claims are consolidated into one claim. All of the members of the class are usually represented by the law firm that filed the class action. The outcome for everyone depends on one single member of the class, known as the “class representative.”
About Multi-District Litigation (MDL)
In the United States, most large and complex drug litigation is often resolved in a Multi-District Litigation (MDL), which is a federal action that centralizes individual lawsuits and class actions into one district court. This process is more efficient, convenient, and cost-effective than multiple class action lawsuits. Furthermore, individual lawsuits remain independent.
What is the problem?
Class actions are designed to maximize efficiency for a lot of people with similar legal claims. They are a good way to seek refunds and reimbursement after buying a defective product. However, class actions have disadvantages for individuals with severe injuries. Members may have to accept a “low-ball” settlement, higher attorneys’ fees, and share the payout with everyone who joins the lawsuit.
Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action
Instead of a class action, our lawyers file individual lawsuits. We specialize in helping victims of dangerous drugs maximize compensation from pharmaceutical companies. We believe there is no excuse for drug-makers who fail to warn about severe side effects. Contact our lawyers today to find out more. We may be able to help you recover damages, such as:
- Pain and suffering
- Medical expenses
- Future care
- Lost income or wages
- Decreased quality of life
- Permanent injury or disability
- Wrongful death of your loved one
