January 14, 2013 — A wrongful death lawsuit has been filed on behalf of an infant who died of birth defects associated with exposure to Zoloft (sertraline) in the womb. The plaintiff, Aubry Eaton, died shortly after her birth on January 6, 2010.
She was born with severe brain malformations, hydrocephalus, and pulmonary hypoplasia. Her family has filed a wrongful death against the pharmaceutical company that manufactures Zoloft, Pfizer Inc.
The lawsuit joins about 250 other Zoloft lawsuits filed on behalf of other children who were born with birth defects after being exposed to Zoloft in the womb. All of these lawsuits have been centralized into one federal court because they make similar allegations against Pfizer.
The Eatons’ lawsuit alleges that Zoloft is unsafe during pregnancy and lacks adequate warnings about the risk of birth defects. It also alleges that Pfizer knew or should have known about the growing research linking antidepressants to birth defects, but failed to update the risk information on the drug.
According to the complaint:
“Despite having extensive knowledge of the extreme risks associated with Zoloft and/or Sertraline usage, as well as the duty to properly and adequately warn foreseeable users, Defendants have never approached the FDA to alter the label for Zoloft and/or Sertraline and, thus, have taken no action to properly and adequately warn of the risks of birth defects associated with Zoloft and/or Sertraline usage during pregnancy.”
